Terms of Service

These Terms of Service ("Terms") govern the access to and use of the runcadence.app website and the RunCadence mobile application (together, the "Service"), published by Cadence (SASU). They form a contract between you and RunCadence.

This English version is a courtesy translation of the French original. In case of discrepancy, the French version prevails.

1. Acceptance

By creating an account or using the Service, you acknowledge that you have read these Terms and accept them without reservation. If you do not agree, do not use the Service.

2. Description of the service

RunCadence is an AI-powered running coach. The Service creates personalized training plans and provides coaching recommendations based on the information you share.

RunCadence is not a substitute for professional medical advice. Always consult a doctor before starting a new training program, especially if you have pre-existing medical conditions. You train at your own risk.

3. Account

  • You must provide accurate information when creating your account.
  • You are responsible for the security of your account and the confidentiality of your credentials.
  • You may delete your account at any time from the app Settings.
  • RunCadence may suspend or terminate accounts that do not comply with these Terms (see section 11).

4. AI coaching

RunCadence uses AI models to generate training plans and provide conversational coaching. While we make every effort to ensure relevance, AI-generated content may contain errors or approximations. Plans are suggestions based on the information you provide and guarantee no specific result (race time, weight loss, performance).

5. Health data

If you grant Apple Health access, RunCadence reads your workout data to enrich your training log. You can revoke this access at any time in your iPhone Settings. Details on how your health data is handled are in our Privacy Policy.

6. Subscription, billing, and refunds

Full access to RunCadence is offered via subscription, after a 14-day free trial. Subscriptions are sold, billed, and managed exclusively by the Apple App Store, under the pricing terms displayed at the time of purchase.

  • The subscription renews automatically at the end of each period, unless cancelled at least 24 hours before the next renewal.
  • Cancellation is done directly from your iPhone Settings (Settings → your name → Subscriptions) or from the iTunes Store. You retain access until the end of the current period.
  • Refund requests go through Apple's process: reportaproblem.apple.com. RunCadence does not have access to your payment method and cannot process refunds directly.
  • If you run into an issue with the app, write to support@runcadence.app; we will help with any Apple-side request.

7. Right of withdrawal and waiver

Under Articles L. 221-18 et seq. of the French Consumer Code, you would in principle have 14 days to withdraw from a distance contract, without having to justify a reason or pay a penalty.

However, pursuant to Article L. 221-28, 13° of the French Consumer Code, you expressly acknowledge that the supply of digital content not delivered on a tangible medium begins upon account creation and the actual start of using RunCadence, during or after the free trial. By starting to use the Service, you accept that contract performance begins immediately and you expressly waive your right of withdrawal.

The 14-day free trial lets you evaluate the Service at no charge; you can cancel at any time during the trial without being billed.

8. Service availability

RunCadence is provided "as is" and reasonable efforts are made to ensure its continuity. RunCadence does not guarantee uninterrupted availability: scheduled maintenance, technical incidents, or failures of a sub-processor (Apple, Anthropic, Supabase, etc.) may cause temporary outages. RunCadence will strive to minimize their duration and impact.

9. Intellectual property

The RunCadence brand, the site, the application, their design, source code, and content are the exclusive property of Cadence (SASU) or of their respective rights holders. Any reproduction, modification, or distribution without prior written authorization is prohibited.

Your training data (plans, sessions, notes, messages) remains yours. You grant RunCadence a non-exclusive, free, and limited license to process it solely to provide the Service, under the conditions described in the Privacy Policy.

10. Limitation of liability

To the maximum extent permitted by law, RunCadence shall not be liable for any injury, health issue, or loss arising from the use of the Service or following AI-generated recommendations. You use the Service at your own risk.

RunCadence shall not be liable for indirect damages (loss of opportunity, loss of data, loss of profit) or for the consequences of a malfunction attributable to a third-party processor (Apple, Anthropic, etc.). These limitations do not apply in case of gross negligence, willful misconduct, or harm to rights that cannot be contractually limited.

11. Suspension and termination

You may delete your account at any time from the app Settings. Deletion triggers the erasure of your data under the conditions set out in the Privacy Policy.

RunCadence may suspend or terminate your access, after a formal notice unanswered for a reasonable period, in case of:

  • violation of these Terms;
  • fraudulent, abusive, or unlawful use of the Service;
  • payment default;
  • conduct that harms the security of the Service or other users.

12. Changes to these Terms

We may update these Terms. Any material change will be notified to you by email or in the app at least 30 days before it takes effect. If you do not accept the new terms, you may cancel your subscription before that date.

13. Governing law and jurisdiction

These Terms are governed by French law. Any dispute related to their formation, performance, or interpretation falls under the exclusive jurisdiction of French courts, subject to mandatory consumer protection rules (in particular the right to bring proceedings in the consumer's place of residence).

In accordance with Article L. 612-1 of the French Consumer Code, in the event of a dispute unresolved after a written complaint, you may resort free of charge to a consumer mediator. You may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
